Wedding Coverage Agreement

WEDDING PHOTOGRAPHY  AGREEMENT

This document is a contractual agreement made between: Eye For Love (referred to hereafter as “Photographer”) and Client.

AGREEMENT TERMS

WEDDING PHOTOGRAPHY AGREEMENT: Client is guaranteed wedding day coverage. These hours include travel time for Photographer(s) to the venue and back to the reception. The event coverage will commence and conclude at time agreed upon. Coverage will include: wedding details, the bride and bridesmaids getting ready, bridal portraits, the groom and groomsmen getting ready, ceremony, family and bridal party portraits, and the remaining time will be used for reception coverage. 

Pre-Event Consultation: The parties agree to a pre-event consultation (by phone, email, or in person) at least one to two weeks before the event date in order to finalize the actual shooting times, locations, client request list and remaining balance. 

Reservation: This signed contract and non-refundable retainer fee of $1000.00 is required to reserve the specified coverage and date. The retainer fee is applied towards the package total. No date is reserved until the contract and retainer are received. 

CANCELLATION/POSTPONEMENT: Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. In the event of a cancellation or postponement of the event/agreement by Client, the amounts paid are non-refundable. Deposits are transferable if a date change is necessary. 90 day notice of postponements is required. In the event of a cancellation less than 90 days prior to the wedding, all payments will be forfeited. Any cancellation or postponement requests must be submitted in writing via email and by phone. In the unlikely event that Photographer must cancel, due to an emergency, Client will be notified immediately via email and phone call, and all deposits and payments will be refunded promptly. Photographer assumes no further liabilities. 

Travel Fees: Travel fees will be applied when deemed applicable, based on, but no limited to charges incurred while traveling to the ceremony and/or reception location (such as hotel, airfare, rental car, gas, meals, supplies, etc.), and appropriate compensation for time spent by photographers and/or assistants traveling to the ceremony and/or reception location. Photographer includes a moderate buffer in their travel fee estimates to cover any unexpected chargers while traveling; once both the client and photographer agree upon the travel fee, both parties will make no further charges of the client without written agreement. Waiver of the hotel fee and/or travel fees will be indicated by a $0 charge in the travel fee section of contract. Tax is not collected on the travel fee total. 

Responsibilities: Unless agreed upon in advance, Eye For Love shall be the exclusive photographer(s) retained for the event. Videographers and other vendors as well as semi- professional photographers must not obstruct or interfere with the official photography and are not allowed to take any still photos during formal sessions. Wedding guest may take photos, but it is the responsibility of the client to prevent family and friends from interfering with photographer duties. Photographer is not responsible for compromised coverage due to causes beyond our control such as other people's camera or flash, the lateness of the bride and groom, family members, and bridal party members or other principles, weather conditions, schedule complications, rendering of decorations, or restrictions of the venues or officiate. Photographer is not responsible for existing backgrounds or lighting conditions, which may negatively impact or restrict the photography coverage 

Harassment: Ensuring the appropriate behavior of all guest and other persons at the wedding and other events covered by photographer shall be the responsibility of the client. In the event photographer experiences any inappropriate, threatening, hostile or offensive behavior from any guest or other person at the wedding or other event (including, but not limited to, unwelcomed sexual advances and verbal or physical conduct of a sexual nature) then the following process shall be followed: First offense: a verbal warning will be issued to a family member of the client; second offense: the offending person will be required to leave the wedding or event; third offense: Photographer will end wedding coverage immediately and leave. Photographer shall be entitled to retain all monies paid hereunder and client agrees to relieve and hold photographer harmless as a result of incomplete wedding photography coverage. 

COOPERATION/NO SHOWS: Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions. 

COPYRIGHT: All images are copyrighted to and remain the property of Eye For Love.

CLIENT’S USAGE: Client is obtaining digital files and a print release. Client understands that Photographer is not responsible for color and print quality for prints obtained through vendors outside of Eye For Love Photography. Prints obtained through Eye For Love Photography are for personal use only. Client shall not sell said prints or authorize any reproductions by parties other than Photographer. Prints for publication (such as editorial, public relations or advertising use) require prior written consent from Photographer. A credit line which reads “Eye For Love Photography” in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs.

Images received from Eye For Love Photography may not be altered from their original version in any way. This includes but is not limited to: turning color images to black and white, adding text, cropping, or color accenting. Photographs are hand edited to Photographer's standards and reflect on the artist. Unedited images will not be given to the client or third party under any circumstance.

EXHIBITION: Client grants Photographer permission to display selected images resulting from this assignment as an example of Photographer’s work and for entrance into photographic competitions and releases all claims to profits that may arise from use of images. Client grants permission for Photographer to display any images on the photographer's website and social media accounts. 

Venue and Location Limitations: Photographer is limited by the rules and guidelines of the location(s) and site management. The client agrees to accept the technical results of their imposition on photographer. Negotiation with officials for moderation of guidelines is the client's responsibility; Photographer will offer technical recommendations only.

Permits: The client is responsible for acquiring all permits and necessary permissions for all locations on which photographer will be performing services. 

Limit of Liability: Photographer warrants and declares that every effort will be made to provide high quality photographic services. We take the utmost care with respect to the exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control, Photographer’s liability is limited to the refund of all payments received, or a reshoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event the photographer(s) is injured or becomes too incapacitated to photograph the event, Eye For Love will make every reasonable effort to secure a replacement photographer. In such an event, client releases Eye For Love from all terms of this contract and all payments received will be returned. If the situation should occur that a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. 

PRINT LIFE: Client is aware that color dyes and inks in non-archival prints may fade or discolor over time due to the inherent qualities of dyes and inks, and Client releases Photographer from any liability for claims whatsoever based upon the fading or discoloration due to the inherent qualities when prints are not purchased from Photographer. Prints purchased from Photographer are guaranteed against natural light fading and will be replaced in the case of unexpected bleaching from sunlight.

PRINT FEES: Prints through the photographer are ordered ala carte. All prints include standard retouching and shipping through the U.S. Postal Service. Prints generally ship via Priority Mail two to four weeks after Client’s print order has been paid in full. Rush printing and shipping can reduce delivery times by one to two weeks. A 50% rush fee is applied to the cost of each rush print. 

Image Storage/Archiving: Photographer professionally archives and stores all RAW wedding images. All RAW files of the client's wedding (digital negatives) are guaranteed to be stored for a minimum time period of 3 months after the wedding date. Request to access the described images after the 3 month time period, may or may not be granted, at the full discretion of photographer. Eye For Love is not responsible for the lifespan or any digital media provided or for any future changes in digital technology. It is the client's responsibility to make sure that digital files are copied to new media as required. 

Engagement Session: If an engagement session is included with a wedding package, it shall take place at least a week prior to the wedding date if not sooner. If the engagement session is at a location outside of the normal travel range of Eye For Love photographers, the client is responsible for any additional travel fees (which will be noted at the time of booking and included in the total package cost). If the client declines or fails to schedule an engagement session with photographer, we shall not be held liable for the lack of the session and will not be required to schedule a replacement session of any kind. 

Shot/Image Request: Due to the unpredictable and uncontrollable nature of weddings, photographer can make NO guarantees regarding the delivery of any specific photograph, although photographer make every reasonable effort to meet the desires of the client. To that end, if specific shots are requested, the client MUST provide photographer with a written list of people, groupings, or shots that they feel are most important to them. It is the sole responsibility of the client to point out VIP guests to photographers and request pictures of them on the day of the wedding. Photographers shall not be held liable or responsible for any persons present at the wedding or reception that were not photographed. No specific pose or photograph can be promised. Photographer will use their professional judgment and sole discretion to select which photos to deliver. 

Meals: A full meal is to be provided for the photographers and/or assistants of Eye For Love, to be consumed while the client is eating, in a location separate from the wedding guests. 

RETOUCHING AND CONVERSIONS: Standard retouching includes light blemish and stray hair removal. Complex retouching includes such changes as the removal of scars or heavy blemishes. Tonal conversions include converting color images to black-and-white. Files are automatically lightly retouched and available in color and black and white for no added fee. Complex retouching may result in an additional fee.

Completion Schedule: Image processing and gallery creation take approximately four to six weeks after event date.

ENTIRE AGREEMENT: This agreement contains the entire understanding between Photographer and Client. It supersedes all prior agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. The waiver by either party of any right under this agreement, or the failure to perform, or of a breach of this agreement by the other party, shall not be deemed a waiver of any other right under this agreement, or of any other breach or failure by the other party whether of a similar nature or otherwise.

This constitutes an order for one Wedding Photography coverage with Eye For Love Photography.
